EPA Proposes Amendments to GHG Reporting Requirements

The Environmental Protection Agency has issued a proposed rule to amend certain of its greenhouse gas (GHG) reporting requirements under 40 CFR Part 98 which took effect in December 2009, pursuant to EPA’s October 2009 final rule establishing mandatory GHG reporting.

Contains Technical Corrections and Clarifications

According to EPA, it is proposing the following changes to clarify certain provisions of 40 CFR Part 98, correct technical and editorial errors, and address certain questions and issues that have arisen since EPA issued its final rule:

  • additional information to better or more fully understand compliance obligations in a specific provision, such as the reference to a standardized method that must be followed;
  • amendments to certain equations to better reflect actual operating conditions;
  • corrections to terms and definitions in certain equations;
  • addition and revision of certain definitions;
  • corrections to data reporting requirements so that they more closely conform to the information used to perform emission calculations;
  • other amendments related to certain issues identified as a result of working with the affected sources during rule implementation and outreach; and
  • changes to correct cross references within and between subparts.

This is EPA’s Second Round of Proposed Corrections & Clarifications
