ITA Fact Sheet on Final AD/CV Rates for Magnesia Carbon Bricks from China and Mexico

The International Trade Administration has issued a fact sheet announcing its affirmative final determinations in the antidumping and countervailing duty investigations of magnesia carbon bricks from China, and in the AD duty investigation for Mexico.

As a result of the final AD determinations, the ITA will instruct U.S. Customs and Border Protection to collect a cash deposit or bond on imports of magnesia carbon bricks based on the final AD rates below.

As a result of the affirmative final CV duty determination (which follows a negative preliminary determination), the ITA will instruct CBP to collect a cash deposit or bond on imports of magnesia carbon bricks based on the final CV duty rates below.

China -- Final AD Rates Range from 128.10% to 236.00%

In the China AD investigation, the ITA has determined that producers/exporters have sold magnesia carbon bricks in the U.S. at margins ranging from 128.10% to 236.00%.

The Chinese mandatory respondent, RHI Refractories Liaoning Co., Ltd., will receive a final AD duty rate of 128.10%. Thirteen additional Chinese producers/exporters qualified for a separate rate of 128.10%.

All other Chinese producers/exporters of magnesia carbon bricks will receive the China-wide entity AD duty rate of 236.00% based on the application of adverse facts available.

Mexico -- Final AD Rate of 57.90%

In the Mexico AD investigation, the ITA has found that producers/exporters have sold magnesia carbon bricks in the U.S. at a margin of 57.90%.

Mexican respondent, RHI-Refmex S.A. de C.V., will receive a final AD duty rate of 57.90%. All other Mexican producers/exporters will also receive a final AD duty rate of 57.90%.

China -- Final CV Rates Range from 24.24% to 253.87%

In the China CV investigation, the ITA has determined that producers/exporters from China have received net countervailable subsidies ranging from 24.24% to 253.87%.

Chinese mandatory respondent, the Mayerton Companies (Dalian Mayerton Refractories Co., Ltd. and Liaoning Mayerton Refractories Co., Ltd.) will receive a CV duty rate of 253.87%, based on the application of adverse facts available.

The other mandatory respondent, the RHI Companies (RHI Refractories Liaoning Co., Ltd., RHI Refractories (Dalian) Co., Ltd., and Liaoning RHI Jinding Magnesia Co., Ltd.), will receive a CV duty rate of 24.24%. All other Chinese producers/exporters will receive a CV duty rate of 24.24%.

ITC to Issue Final Injury Determinations in September 2010

The ITC is scheduled to issue its final injury determinations on or about September 9, 2010. If the ITC makes affirmative determinations that imports of magnesia carbon bricks from China and/or Mexico materially injure, or threaten material injury to, the domestic industry, the ITA will issue AD and CV duty orders. If the ITC makes negative injury determinations, these investigations will be terminated.
