ITC Ends Patent Investigation of Devices/Software Brought by Motorola against BlackBerry Mfr

The International Trade Commission has terminated the section 337 patent-based investigation of certain wireless communication devices and their corresponding software and battery packs, brought by Motorola, Inc., on the basis of a settlement agreement.

Investigation Based on Complaint Filed by Motorola Against BlackBerry Mfr

The complaint filed by Motorola, Inc., of Schaumberg, IL, alleged violations of section 337 of the Tariff Act of 1930 in the importation into the U.S. and sale of certain wireless communication system server software, wireless handheld devices and battery packs that infringe patents asserted by Motorola.

The complaint was filed against Research In Motion, Ltd., of Canada; and Research In Motion Corporation of Irving, TX (collectively, RIM), the designer and manufacturer of the BlackBerry smartphone. RIM also creates solutions for the worldwide mobile communications market, including the software that allows the BlackBerry smartphone to provide mobile access to email, applications, media and the Internet.

Motorola, RIM Filed Joint Motion to Terminate

The ITC has determined to terminate the investigation based on Motorola and RIM’s joint motion to terminate the investigation on the basis of a settlement agreement.
