China Steel Wire Hangers: Initiation of AD Anti-Circumvention Inquiries

The International Trade Administration is initiating two anti-circumvention inquiries to determine whether certain imports of steel wire garment hangers from Vietnam are circumventing the antidumping duty order on steel wire garment hangers from China (A-570-918).

ITA to Determine if Circumvention by Two Vietnamese Companies

The ITA will determine whether imports of steel wire garment hangers by two Vietnamese companies, alleged to be pre-formed in China and completed in Vietnam, are circumventing the AD duty order on hangers from China.

Specifically, the petitioner alleges that Angang Clothes Rack Manufacture Co., Ltd. is circumventing the order with the help of its alleged affiliate, China-based Shaoxing Gangyuan Metal Manufactured Co., Ltd., and that Quyky Yanglei International Co., Ltd. is circumventing the order with the help of its alleged affiliates, China-based Shanghai Ruishan Metal Products Co., Ltd. and Zhejiang Taizhou Hongda Metal Products Co., Ltd. (collectively, Ruishan-Taizhou).

The petitioner further alleges that Gangyuan and Ruishan-Taizhou are supplying pre-formed hangers to Angang and Quyky, respectively, for completion or assembly into merchandise of the same class or kind as the merchandise covered by the order, which constitutes circumvention.

Suspension of Liquidation, Cash Deposit if Preliminary Affirmative Determination

If the ITA issues a preliminary affirmative determination, it will then instruct U.S. Customs and Border Protection to suspend liquidation and require a cash deposit of estimated duties on the merchandise.

The ITA intends to issue its final determination within 300 days of July 22, 2010.

(The ITA notes that these anti-circumvention inquiries cover Angang and Quyky only. If the ITA receives a formal request from an interested party regarding potential circumvention by other Vietnamese companies, it will consider conducting additional inquiries concurrently.)
