China Wire Decking: ITC Makes Final Negative Injury Determinations, No AD/CV Orders to be Issued

The International Trade Commission has issued a press release announcing its determinations that a U.S. industry is neither materially injured nor threatened with material injury by reason of imports of wire decking from China.

As a result of these final negative injury determinations, no antidumping or countervailing duty orders will be issued on imports of wire decking from China.

(Four Commissioners voted in the negative, and two voted in the affirmative.)

ITA AD/CV Suspension of Liquidation to be Terminated, Cash Deposits Refunded

No AD or CV duty order will be issued on wire decking from China, and the suspension of liquidation will be terminated and all estimated duties deposited or securities posted during the International Trade Administration investigations will be refunded or canceled.

(The ITA recently made final affirmative determinations that wire decking from China is being, or is likely to be, sold in the U.S. at less than fair value, and that countervailable subsidies are being provided to producers and exporters of wire decking from China.

In the AD investigation, the ITA found that Chinese producers/exporters sold wire decking in the U.S. at 14.24% to 143.00% less than normal value. In the CV investigation, the ITA determined that Chinese producers/exporters received net countervailable subsidies of 1.52% to 437.11%.
