China Garlic: Final Results of AD Duty Administrative Review

(a) For subject merchandise exported by all other China exporters of subject merchandise that have not been found to be entitled to a separate rate, the AD duty cash deposit rate will be the per-unit China-wide entity rate determined in the final results of administrative review;

(b) For previously-investigated or previously-reviewed China and non-China exporters who received a separate rate in a prior segment of the proceeding (and which were not reviewed in this segment of the proceeding), the AD duty cash deposit rate will continue to be the rate assigned in that segment of the proceeding; and

(c) The AD duty cash deposit rate for non-China exporters of subject merchandise which have not received their own rate will be the rate applicable to the China exporter that supplied that non-China exporter.

Assessment Instructions

The ITA intends to issue appropriate assessment instructions directly to U.S. Customs and Border Protection 15 days after June 21, 2010. The ITA will direct CBP to assess a per-unit (i.e., per kilogram) amount on each entry of the subject merchandise during the review period.
