Effective Date of Bath Seat Final Rule & Manufacture Date Corrected

On page 31689 of the June 4, 2010 accreditation requirements notice, in the third column, in the first full paragraph, the effective date of the referenced bath seat final rule is changed from December 1 to December 6, 2010, and the manufacture date is changed from December 2 to December 7, 2010. In addition, on page 31691, the manufacture date is changed from December 1 to December 7, 2010.

Changes Mean Bath Seats Mfrd on/after Dec 7 Need CPSIA Testing/Certification

These changes reflect the fact that CPSC’s concurrently published final rule establishing a mandatory standard for infant bath seats took effect December 6, 2010 (not December 1, 2010).

In addition, the corrections reflect CPSC’s intent that the third-party testing and certification requirements of the Consumer Product Safety Improvement Act of 2008 (CPSIA) for bath seats coincide with the effective date of the final rule on bath seats.

Therefore, third-party testing by a CPSC-recognized lab and certification by the domestic manufacturer (in the case of domestic products) or importer (in the case of imports) will be required for bath seats manufactured on or after December 7, 2010.
