China Magnesia Carbon Bricks: Preliminary Determination of AD Critical Circumstances

The International Trade Administration has made a preliminary affirmative determination of critical circumstances in the antidumping duty investigation of certain magnesia carbon bricks from China (A-570-954).

The ITA is issuing this determination pursuant to the petitioner’s AD critical circumstances allegation.

AD Suspension of Liquidation Now Begins December 14, 2009

The ITA preliminarily finds that critical circumstances exist for imports of subject merchandise from mandatory respondents RHI Refractories Liaoning Co., Ltd., Liaoning Mayerton Refractories Co., Ltd. and Dalian Mayerton Refractories Co., Ltd.; the separate rate respondents; and the China-wide entity in this AD duty investigation.

Therefore, the ITA is directing U.S. Customs and Border Protection to suspend liquidation of any unliquidated entries of magnesia carbon bricks from China with a time of entry on or after December 14, 2009 (90 days prior to the publication date of the preliminary determination).

(Suspension of liquidation previously began on March 12, 2010 pursuant to the original preliminary AD duty determination.)
