CBP Announces CY 2010 “Low Duty” TRQ Quantity for Canned Tuna and Skipjack

U.S. Customs and Border Protection has issued a notice announcing that the calendar year 2010 in-quota (low duty) tariff rate quota quantity for tuna and skipjack (tuna), in airtight containers, not in oil, weighing with their contents not over 7 kilograms each, that is not the product of any U.S. insular possession, as described in HTS 1604.14.22 (6% duty) has been set at 16,618,716 kg.

Tuna Entered in Excess of Low-Duty Quantity Will Be Subject to Higher Duty

Any such tuna that is entered or withdrawn from warehouse for consumption during CY 2010 in excess of this quantity will be dutiable at the over-quota (high duty) rate of 12.5% under HTS 1604.14.30.

CBP previously issued a memorandum announcing that it was informed that the final TRQ limit for tuna and skipjack would be delayed in order to complete data compilation by the National Marine Fisheries Service. Upon receipt, CBP would issue proration and liquidation instructions; however, the delay may have an impact on final warehouse withdrawals for consumption submitted for opening moment.

(In December 2009, CBP issued a notice announcing a preliminary low duty TRQ quantity of 18,026,536 kg for such tuna. This TRQ opened on January 4, 2010, under opening moment procedures, with high duty tariff numbers and rates in effect for all entry/entry summaries. CBP subsequently announced that the preliminary low duty TRQ for such tuna oversubscribed at opening.)
