AD: Indonesia Polyethylene Retail Carrier Bags

The International Trade Administration has made a final affirmative antidumping determination that polyethylene retail carrier bags (PRCBs) from Indonesia are being, or are likely to be, sold in the U.S. at less than fair value.

AD Suspension of Liquidation

The ITA will direct U.S. Customs and Border Protection to continue to suspend liquidation of all entries of PRCBs from Indonesia with a time of entry on or after November 3, 2009.

AD Cash Deposit Requirements

The ITA will also direct CBP to require a cash deposit or bond at the revised AD duty rates below for entries of PRCBs from Indonesia with a time of entry on or after April 1, 2010:

(The ITA notes that if the exporter is not a firm identified in this investigation but the producer is, the rate will be the rate established for the producer of the subject merchandise.)

AD Duty Order to be Issued if ITC finds Injury/Threat of Injury

The International Trade Commission will determine within 45 days whether imports of the subject merchandise are causing material injury or threat of material injury to an industry in the U.S. If the ITC determines that such injury does exist, the ITA will issue an AD duty order.
