AD: Vietnam Certain Frozen Fish Fillets

The International Trade Administration has issued the final results of its antidumping duty administrative and new shipper reviews of certain frozen fish fillets from Vietnam for the period of August 1, 2007 through July 31, 2008.

(a) For previously investigated companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period of review;

(b) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(c) The AD duty cash deposit rate for all other manufacturers or exporters will be the Vietnam-wide entity rate of $2.11 per kilogram.

Assessment Instructions for the Review Period (08/01/07 - 07/31/08)

The ITA intends to issue appropriate assessment instructions directly to U.S. Customs and Border Protection 15 days after March 17, 2010.

The ITA has calculated importer-specific duty assessment rates on a per-unit basis. In this and future reviews, the ITA will direct CBP to assess importer-specific assessment rates based on the resulting per-unit (i.e., per-kilogram) rates by the weight in kilograms of each entry of the subject merchandise during the review period.

Vietnam-Wide Assessment Rate Applies to ESS JVC After Name Change Date

With respect to ESS JVC, the ITA will instruct CBP to asses $0.02 per kilogram on all appropriate entries up to June 17, 2008, the effective date of the name change from ESS JVC to ESS LLC. Any entries made on or after June 17, 2008, by ESS JVC will be assessed at the Vietnam-wide entity rate of $2.11 per kilogram.

With respect to ESS LLC, the ITA shall instruct CBP to assess $2.11 per kilogram on all appropriate entries made during the review period as it remains part of the Vietnam-wide entity.
