As a result of this preliminary determination, the ITA will instruct U.S. Customs and Border Protection to collect cash deposits or bonds based on the preliminary AD duty rates below.

Preliminary AD Rates Range from 69.58% to 95.40%

The ITA preliminarily found that Chinese producers/exporters have sold potassium phosphate salts in the U.S. at 69.58% to 95.40% less than fair value.

Mandatory respondents SD BNI (LYG) Co. Ltd. and SiChuan Blue Sword Import & Export Co., Ltd. failed to submit the information required and as a result, the ITA has preliminarily assigned both mandatory respondents a rate of 95.40% as part of the China-wide entity.

Four companies qualified for a separate AD duty rate of 69.58%. All other exporters have been assigned a preliminary China-wide entity rate of 95.40%.

Final Determination Scheduled for July 2010

The ITA is currently scheduled to issue its final AD duty determination in July 2010.
