This review has been initiated to determine whether Far Eastern New Century Corporation is the successor-in-interest to Far Eastern Textile Limited for purposes of determining AD duty liability.
FENC is Preliminarily Successor-in-Interest to FET
The ITA preliminarily determines that Far Eastern New Century Corporation is the successor-in-interest to Far Eastern Textile Limited and, as a result, should be accorded the same treatment previously accorded to Far Eastern Textile Limited with regard to the AD duty order on polyester staple fiber from Taiwan (currently 1.97%). (See ITT's Online Archives or 04/22/09 news, 09042240, for BP summary of the most recent final results of AD duty administrative review for FET.)
The AD duty cash deposit rate for Far Eastern New Century Corporation will be altered, if warranted, pursuant only to the final results of this review. The ITA will issue the final results of its review not later than 270 days after January 19, 2010, or within 45 days if all parties agree to the preliminary results.
(See ITA notice for more information, including the scope of the order, etc.)
