ITA Corrects Scope of its Final 2009 "Expected NME Wages" Notice

The International Trade Administration has issued a correction to its notice of final 2009 calculation of expected non-market economy (NME) wages for use as the surrogate value for direct labor in antidumping proceedings involving NME countries, in order to limit the scope of AD proceedings to which these wages will be applied.

Wages to be Applied to AD Proceedings That Have Not Reached Prelim Results

The ITA clarifies that it will apply the 2009 expected NME final wage rates to AD proceedings subsequent to December 8, 2009 (the publication date of the ITA's final notice of 2009 calculations) for which the ITA has not yet reached the preliminary results of a review (i.e., preliminary results of administrative or new shipper review). The final 2009 notice remains in effect in all other respects.

(In the final 2009 notice issued in early December, the ITA stated that the final wage rates would be applied to all AD proceedings for which the ITA's final determination is due.)
