AD: Thailand Polyethylene Retail Carrier Bags

The International Trade Administration has issued the final results of its antidumping duty administrative review of polyethylene retail carrier bags from Thailand for the period of August 1, 2007 through July 31, 2008.

AD Cash Deposit Instructions for a Time of Entry on or after 12/11/09:

(a) For previously investigated or reviewed companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;

(b) If the exporter is not a firm covered in this or a previous review or the AD investigation but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(c) The AD duty cash deposit rate for all other manufacturers or exporters will continue to be 2.80%, the all-others rate from the amended final determination of the AD investigation.

Assessment Instructions for the Review Period (08/01/07 - 07/31/08)

The ITA intends to issue assessment instructions to U.S. Customs and Border Protection 15 days after December 11, 2009. The ITA has imported importer/customer-specific duty assessment rates for TPBG.

Because it is relying on total adverse facts available to establish the AD margin for Master Packaging, the ITA will instruct CBP to apply an AD margin of 122.88% to all entries of subject merchandise produced and/or exported by Master Packaging.

The ITA adds that for entries of subject merchandise during the review period produced by TPBG for which it did not know that the merchandise it sold to an intermediary (e.g., a reseller, trading company, or exporter) was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no rate for the intermediary(ies) involved in the transaction.
