CV Liquidation Instructions
For this investigation, the four month period for which the CV suspension of liquidation may remain in effect before the order is issued began on April 6, 2009 (the publication date of the preliminary determination) and ended on August 3, 2009.
As an ITC final affirmative injury determination was published on December 10, 2009, the ITA will instruct CBP to terminate the CV suspension of liquidation and to liquidate, without regard to CV duties, unliquidated entries of commodity matchbooks from India with a time of entry from August 4, 2009 through December 9, 2009.
CV suspension of liquidation continues for subject merchandise with a time of entry on or after December 10, 2009.
(For entries with a time of entry on or after April 6, 2009 through August 3, 2009, CV suspension of liquidation and CV duty liability also remain in effect.)
Entries of Subject Merchandise During Gap Period Are Not Liable for CV Duties
Entries of subject merchandise from India with a time of entry during the "gap period", on or after August 4, 2009 through December 9, 2009, are not liable for the assessment of CV duties.
CV Cash Deposit Requirements
The ITA will also instruct CBP to require, at the same time as importers would normally deposit estimated duties, CV cash deposits at the rates specified below (which are unchanged from the final CV duty determination) for entries of subject merchandise with a time of entry on or after December 10, 2009:
