The ITA is amending its preliminary AD determination to correct certain ministerial errors with respect to the AD duty rate calculation for P.T. Super Exim Sari Ltd. and P.T. Super Makmur (collectively, SESSM). The corrections to the margin for SESSM also affect the calculation of the all others rate.
Suspension of Liquidation Continues
The ITA will direct U.S. Customs and Border Protection to continue to suspend liquidation of all entries of PRCBs from Indonesia with a time of entry on or after November 3, 2009.
Refund of AD Cash Deposits
The ITA will also issue instructions to CBP authorizing it to refund the AD duty deposits made by SESSM and the companies subject to the all-others rate in excess of the following amended AD duty rates on or after November 3, 2009:
| Company | Amended Prelim Rate |
|---|---|
| P.T. Sido Bangun Indonesia (SBI) | 67.62% (unchanged) |
| P.T. Super Exim Sari Ltd. and P.T. Super Makmur (collectively, SESSM) | 9.10% (from 67.18%) |
| All Others | 38.14% (from 67.40%) |
(See ITA notice for additional information, including the scope of the investigation (which remains unchanged from the initiation notice), etc.
