CPSC Briefing on CPSIA Testing/Certification Stay & Enforcement Issues, Drywall Tracking
The Commissioners of the Consumer Product Safety Commission will hold an open briefing on December 2, 2009 to consider two issues related to Consumer Product Safety Improvement Act of 2008 testing and certification and one regarding drywall.

(Note that CPSC has yet to vote on a comprehensive draft guidance document on CPSIA testing and certification (much of which is currently stayed) and will hold a public workshop in December on testing and certification. In addition, CPSC is involved in an ongoing investigation of possible health and electrical corrosion problems associated with Chinese drywall installed in homes.)
During the briefing, the Commissioners will consider:
Action on CPSIA testing/certification stay. The Commission will consider action on its one year stay of enforcement of much of the testing and certification required by the CPSIA (including lead content, phthalates, etc.) that is due to expire February 10, 2010, when the Commissioners are to vote on the stay.
Note that during a November 9, 2009 briefing, the Commissioners discussed various options regarding the stay, including lifting it completely, partially lifting it, and keeping it in place. Enforcement of lead component testing/certification. The Commission will also consider an interim enforcement policy on component testing and certification for lead paint and lead content. (In October 2009, CPSC issued a policy statement providing guidance on testing and certification of children's products for compliance with the CPSIA lead content limits, including interim guidance on component testing. Tracking labels for drywall. The Commission will also consider a notice of inquiry regarding tracking labels for drywall. (See ITT's Online Archives or 11/25/09 and 07/14/09 news, 091125994 and 09071410, for most recent BP summaries of CPSC's drywall investigation.)
