AD: Vietnam Polyethylene Retail Carrier Bags

The International Trade Administration has made a preliminary affirmative antidumping determination that polyethylene retail carrier bags (PRCBs) from Vietnam are being, or are likely to be, sold in the U.S. at less than fair value.

Combination Rates

The ITA has calculated combination rates for respondents that are eligible for a separate rate in this investigation. (See ITT's Online Archives or 04/11/05 news, 05041110, for BP summary of 2005 policy bulletin outlining this change in practice with regard to AD combination rates for non-market economies (NMEs).)

AD Suspension of Liquidation

The ITA will direct U.S. Customs and Border Protection to suspend liquidation of all entries of PRCBs from Vietnam with a time of entry on or after November 3, 2009.

AD Cash Deposit Requirements

The ITA will also direct CBP to require a cash deposit or bond for entries of PRCBs from Vietnam with a time of entry on or after November 3, 2009 for the manufacturer/exporter combinations listed below at the following AD duty rates:

Postponement of Final AD Duty Determination

The ITA is also postponing the deadline for its final determination until 135 days from November 3, 2009. Suspension of liquidation will be extended accordingly.
