Assessment Instructions for the Review Period (05/01/07 - 04/30/08)
The ITA will issue assessment instructions directly to CBP 15 days after October 18, 2009. It has calculated importer- or customer- specific ad valorem duty assessment rates for subject merchandise.
The ITA adds that for entries of subject merchandise during the review period produced by the respondent for which it did not know its merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no rate for the intermediate company(ies) involved in the transaction. (See ITT's Online Archives or 06/02/03 news, 03060245, for BP summary of the ITA's May 2003 "automatic assessment" regulation.)
(The ITA notes that it has been enjoined from liquidating entries of the subject merchandise produced and exported by Ugine & ALZ Belgium N.V. (U&A Belgium). Therefore, it does not intend to issue liquidation instructions to CBP for entries made during the review period by U&A Belgium.)
(See ITA notice for more information, including the scope of the order, changes since the preliminary results, etc.
See ITT's Online Archives or 06/08/09 news, 09060840, for BP summary of the preliminary results of this AD duty administrative review.)
