AD: Italy Pressure Sensitive Plastic Tape

The International Trade Administration is initiating an antidumping duty changed circumstances review of pressure sensitive plastic tape from Italy.

The ITA is initiating this review to determine whether Evotape Packaging S.r.l. is the successor-in-interest to Tyco Adhesives Italia S.p.A. for purposes of determining AD liability.

ITA to Assign Tyco's Zero AD Rate to Evotape If Successor-in-Interest

If the evidence demonstrates that, with respect to the production and sale of the subject

merchandise, Evotape Packaging operates as the same business entity as Tyco, the ITA will accord Evotape Packaging the same AD duty rate as Tyco (currently zero).

During the course of this AD duty changed circumstances review, cash deposit requirements for the subject merchandise produced and exported by Evotape Packaging will continue to be the all-others rate established in the investigation. The cash deposit rate requirement will be altered, if warranted, pursuant only to the final results of this review.

The ITA will issue the final results of this AD duty changed circumstances review not later than 270 days after September 10, 2009, or within 45 days if all parties to the proceeding agree to the preliminary results.
