AD: China Certain Woven Electric Blankets

The International Trade Administration has initiated an antidumping duty investigation to determine whether imports of certain woven electric blankets from China are being, or are likely to be, sold in the U.S. at less than fair value.

Q&V Questionnaires Due by August 11th

For this investigation, the ITA is requesting quantity and value (Q&V) information from exporters and producers listed in the AD petition. The Q&V data received will be used as a basis to select the mandatory respondents.

Separate Rate Applications Due by September 25th

The ITA also requires exporters and producers seeking separate rate status in this AD duty investigation to submit a separate rate application no later than September 25, 2009. The separate rate application is available at http://ia.ita.doc.gov/ia-highlights-and-news.html.

The ITA requires that the respondents submit a response to both the Q&V questionnaire and the separate rate application by the respective deadlines in order to receive consideration for separate rate status.

The ITA will also calculate combination rates for certain respondents that are eligible for a separate rate in this investigation.

Comments on Targeted Dumping Due October 23rd

Any interested party that wishes to make a targeted dumping allegation in the AD investigation may submit allegations by October 23, 2009 (i.e., no later than 45 days before the scheduled date of the ITA's preliminary determination).

(Note that in December 2008, the ITA issued an interim final rule for the purposes of withdrawing the regulations governing targeted dumping analysis in AD duty investigations. Comments on Product Characteristics for AD Questionnaire Due by August 10th

The ITA is also requesting comments from interested parties regarding the appropriate physical characteristics of woven electric blankets to be reported in response to the AD questionnaire.

This information will be used to identify the key physical characteristics of the subject merchandise in order to more accurately report the relevant factors and costs of production, as well as to develop appropriate product comparison criteria.

Comments on product characteristics to be reported in response to the AD questionnaire must be submitted by August 10, 2009. (Rebuttal comments are due by August 17, 2009.)

Scope of the Investigation

The scope of this investigation covers finished, semi-finished, and unassembled woven electric blankets, including woven electric blankets commonly referred to as throws, of all sizes and fabric types, whether made of man-made fiber, natural fiber or a blend of both. Semi-finished woven electric blankets and throws consist of shells of woven fabric containing wire.

Unassembled woven electric blankets and throws consist of a shell of woven fabric and one or more of the following components when packaged together or in a kit: (1) wire; (2) controller(s). The shell of woven fabric consists of two sheets of fabric joined together forming a "shell." The shell of woven fabric is manufactured to accommodate either the electric blanket's wiring or a subassembly containing the electric blanket's wiring (e.g., wiring mounted on a substrate).

A shell of woven fabric that is not packaged together, or in a kit, with either wire, controller(s), or both, is not covered by this investigation even though the shell of woven fabric may be dedicated solely for use as a material in the production of woven electric blankets.

HTS classification. The finished, semi-finished and unassembled woven electric blankets and throws subject to this investigation are currently classifiable under Harmonized Tariff Schedule subheading 6301.10.0000.

The ITA notes that although the HTS subheading is provided for convenience and customs purposes, the written description of the scope is dispositive.
