(a) With regard to the new shipper review, for subject merchandise exported by but not produced by Yuanli, the AD duty cash deposit rate will be the China-wide entity rate;
(b) For previously investigated or previously reviewed China and non-China exporters who received a separate rate in a prior segment of the proceeding (which were not reviewed in this segment of the proceeding), the AD duty cash deposit rate will continue to be the rate assigned in that segment of the proceeding;
(c) For subject merchandise exported by all other China exporters of subject merchandise that have not been found to be entitled to a separate rate, the AD duty cash deposit rate will be the per-unit China-wide entity rate; and
(d) The AD duty cash deposit rate for non-China exporters of subject merchandise which have not received their own rate will be the rate applicable to the China exporter that supplied that non-China exporter.
Assessment Instructions for the Review Period (11/01/06 - 10/31/07)
The ITA will issue appropriate assessment instructions directly to U.S. Customs and Border Protection 15 days after June 19, 2009.
For assessment purposes, the ITA calculated importer-specific assessment rates for fresh garlic from China. Moreover, the ITA is calculating per-unit cash deposit and assessment rates for separate rate respondents and companies that are part of the China-wide entity.
