AD: India Certain Hot-Rolled Carbon Steel Flat Products

The International Trade Administration has issued the final results of its antidumping duty administrative review of certain hot-rolled carbon steel flat products from India for the period of December 1, 2006 through November 30, 2007.

(a) For previously reviewed or investigated companies other than those covered by this review, the AD duty cash deposit rate will be the company-specific rate established for the most recent period;

(b) If the exporter is not a firm covered in this review, a prior review, or the AD investigation, but the producer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the subject merchandise; and

(c) If neither the exporter nor the manufacturer has its own rate, the AD duty cash deposit rate will be 38.72%, the all-others rate published in the amended final AD duty determination and order1.

1The ITA notes that the all-others cash deposit rate is reduced to account for the export subsidy rate found in the countervailing duty investigation.

Assessment Instructions for the Review Period (12/01/06 - 11/30/07)

The ITA intends to issue assessment instructions to U.S. Customs and Border Protection 15 days after April 20, 2009. The ITA has calculated importer-specific duty assessment rates for subject merchandise.

The ITA adds that for entries of subject merchandise during the review period produced by Essar for which Essar did not know that their merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no company-specific rate for an intermediary involved in the transaction.
