AD: China Citric Acid and Certain Citrate Salts
The International Trade Administration has made a final affirmative antidumping duty determination that citric acid and certain citrate salts from China are being, or are likely to be, sold in the U.S. at less than fair value.

Combination Rates
The ITA has calculated combination rates for respondents that are eligible for a separate rate in this investigation. (See ITT's Online Archives or 04/11/05 news, 05041110, for BP summary of 2005 policy bulletin outlining this change in practice with regard to AD combination rates for non-market economies (NMEs).)
Suspension of Liquidation
The ITA is directing U.S. Customs and Border Protection to continue to suspend liquidation of entries of subject merchandise from China with a time of entry on or after November 20, 2008.
AD Cash Deposit/Bond Instructions
The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the revised AD duty rates listed below1, for entries of subject merchandise with a time of entry on or after April 13, 2009:

1The AD duty rates listed above are revised from the preliminary AD duty determination. Additionally, the ITA states that the AD rates are adjusted for the export subsidy rate determined in the companion countervailing duty determination (i.e., a countervailable subsidy of 1.76%), where applicable. AD Duty Order to be Issued if ITC finds Injury/Threat of Injury
Within 45 days, the International Trade Commission will determine whether the domestic industry in the U.S. is materially injured, or threatened with material injury, by reason of imports or sales (or the likelihood of sales) for importation of the subject merchandise.
If the ITC determines that material injury or threat of material injury does not exist, the proceeding will be terminated and all securities posted will be refunded or canceled. If the ITC determines that such injury does exist, the ITA will issue an AD duty order.
Final Changes to the Scope of the Investigation
The ITA has implemented the following changes of certain sections of the scope of investigation, which were preliminarily amended in the ITA's preliminary determination from its original initiation notice (deleted text is crossed out, added text is underlined; see final determination for the complete scope):
(1) "The scope of this investigation also includes all forms of unrefinedcrude calcium citrate, including dicalcium citrate monohydrate, and tricalcium citrate tetrahydrate, which are intermediate products in the production of citric acid, sodium citrate, and potassium citrate.
(2) The scope of this investigation does not include calcium citrate that satisfies the standards set forth in the United States Pharmacopeia and has been mixed with a functional excipient, such as dextrose or starch, where the excipient constitutes at least 2%, by weight, of the product.
(3) Potassium citrate and crude calcium citrate are classifiable under HTS 2918.15.5000 and 3824.90.9290, respectively.
