AD: Mexico Gray Portland Cement and Clinker

The International Trade Administration is revoking the antidumping duty order, effective April 1, 2009, on gray portland cement and clinker from Mexico (cement order) pursuant to the final results of its changed circumstances review, and is terminating the five-year sunset review.

(In March 2006, the Office of the U.S. Trade Representative, the Mexican Secretaria de Economia, and the ITA entered into an Agreement on Trade in Cement (Agreement).

The ITA has previously stated that the Agreement would expire on March 31, 2009, at which time the ITA would revoke the AD duty order effective April 1, 2009, if all the terms of the agreement were complied with by interested parties.)

Liquidation Reinstated, Cash Deposits Ceased Effective April 1st

Because the ITA determines that the terms of the Agreement and, therefore, the terms of the "no interest" letters from producers accounting for substantially all of the production of the domestic like product have been met, the ITA hereby revokes the AD duty order on gray portland cement and clinker from Mexico in its entirety, effective April 1, 2009.

The ITA will instruct U.S. Customs and Border Protection to discontinue the suspension of liquidation and to cease the collection of cash deposits on entries of subject merchandise with a time of entry on or after April 1, 2009.

In addition, the ITA will instruct CBP to liquidate all entries made on or after April 1, 2009, without regard to AD duties.
