AD: China Small Diameter Graphite Electrodes

Combination Rates
The ITA calculated combination rates for respondents that are eligible for a separate rate in this investigation. (See ITT's Online Archives or 04/11/05 news, (Ref: 05041110), for BP summary of 2005 policy bulletin outlining this change in practice with regard to AD combination rates for non-market economies (NMEs).)
ITC Now Finds Negative Critical Circumstances
The International Trade Commission has now made a negative critical circumstances determination in this investigation. (The ITA previously made an affirmative critical circumstances determination in its final AD determination for all respondents and the China-wide entity.)
Therefore, the ITA will instruct U.S. Customs and Border Protection to lift suspension, release any bond or other security, and refund any cash deposits made to secure the payment of AD duties with respect to entries with a time of entry during the 90 days prior to August 21, 2008 (the publication date of the preliminary determination).
AD Suspension of Liquidation and Cash Deposit/Bond Instructions
For this investigation, the six month period for which AD suspension of liquidation and cash deposit/bond requirement may remain in effect before an order is issued for subject merchandise began August 21, 2008 and ended February 16, 2009. Therefore, for entries with a time of entry on or after August 21, 2008 through February 16, 2009, AD suspension of liquidation remains in effect.
AD suspension of liquidation (with a cash deposit/bond requirement) resumes for subject merchandise from China with a time of entry on or after February 25, 2009 (the publication date of the ITC's final injury determination).
(The ITA will instruct CBP to terminate the suspension of liquidation and to liquidate, without regard to AD duties, unliquidated entries of uncovered innerspring units from China with a time of entry from February 17, 2009 through February 24, 2009.)
Entries of Subject Merchandise During Gap Period Are Not Liable for AD Duties
Entries of subject merchandise from China with a time of entry during the "gap period," on or after February 17, 2009 through February 24, 2009, are not liable for the assessment of AD duties.
AD Cash Deposit Requirements
The ITA will also instruct CBP to require, at the same time as importers would normally deposit estimated duties, AD cash deposits at the rates specified below for entries of subject merchandise with a time of entry on or after February 25, 2009:
