CV: Italy Certain Pasta

The International Trade Administration has issued its final results of the countervailing duty administrative review of certain pasta from Italy for the period of January 1, 2006 through December 31, 2006.

(a) The ITA has determined a CV duty rate of 0.00% for Felicetti, therefore, no cash deposit is required; however, suspension of liquidation continues; and

(b) For all non-reviewed firms (except Barilla G. e R. F.lli S.p.A. and Gruppo Agricoltura Sana S.r.l., which are excluded from the order, and Pasta Lensi S.r.l. which was revoked from the order), the ITA will instruct U.S. Customs and Border Protection to collect cash deposits of estimated CV duties at the most recent company-specific or all-others rate applicable to the company. These rates shall apply to all non-reviewed companies until a review of a company assigned these rates is requested.

Assessment Instructions for the Review Period (01/01/06 - 12/31/06)

The ITA will issue appropriate assessment instructions directly to CBP 15 days after February 3, 2009.

Because the CV duty rate for Felicetti is zero, the ITA will instruct CBP to liquidate entries for Felicetti during the review period without regard to CV duties. For De Matteis, Garofalo, and De Cecco, the ITA will instruct CBP to assess CV duties at the net subsidy rates above.

For all other companies that were not reviewed (except Barilla G. e R. F.lli S.p.A. and Gruppo Agricoltura Sana S.r.l., which are excluded from the CV order, and Pasta Lensi S.r.l. which was revoked from the CV order), the ITA has directed CBP to assess countervailing duties on all entries during the review period at the rates in effect at the time of entry.
