AD: Thailand Polyethylene Retail Carrier Bags
The International Trade Administration has issued its final results of the antidumping duty administrative review of polyethylene retail carrier bags from Thailand for the period of August 1, 2006 through July 31, 2007.

AD Cash Deposit Instructions for a Time of Entry on or after 01/15/09:

(a) For previously investigated or reviewed companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;
(b) If the exporter is not a firm covered in this or a previous review or the original AD investigation but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise;
(c) The AD duty cash deposit rate for all other manufacturers or exporters will continue to be 2.80%, the all-others rate from the amended final determination of the AD investigation.
Assessment Instructions for the Review Period (08/01/06 - 07/31/07)
The ITA intends to issue assessment instructions to U.S. Customs and Border Protection 15 days after January 15, 2009.
The ITA has calculated importer-specific duty assessment rates for the subject merchandise with respect to export-price sales by NPG and Poly Plast. Because the ITA is relying on total adverse facts available (AFA) to establish the dumping margins for King Pac and Master Packaging, the ITA will instruct CBP to apply a dumping margin of 122.88% to all entries of subject merchandise produced and/or exported by these companies.
The ITA adds that for entries of subject merchandise during the review period produced by companies included in these final results of review for which the reviewed companies did not know that the merchandise it sold to an intermediary (e.g., a reseller, trading company, or exporter) was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate if there is no rate for the intermediary involved in the transaction.
