AD Cash Deposit Instructions for a Time of Entry on or after 12/10/08:
| Company | AD Rate |
|---|---|
| Fujian Golden Banyan Foodstuffs Industrial Co., Ltd.1, as producer and exporter | (a) |
| Other Companies | (b),(c) |
(a) The ITA has found an AD duty rate of zero for subject merchandise produced and exported by Golden Banyan, therefore, no cash deposit is required; however, it is still subject to the order;
(b) For subject merchandise exported but not manufactured by Golden Banyan, the AD duty cash deposit rate will continue to be the China-wide entity rate (i.e., 198.63%); and
(c) For subject merchandise manufactured by Golden Banyan, but exported by any party other than Golden Banyan, the AD duty cash deposit rate will be the rate applicable to the exporter.
1The ITA notes that at the time Golden Banyan submitted its request for a new shipper review, it was in the process of seeking government approval to change its name from Zhangzhou Golden Banyan Foodstuffs Industrial Co., Ltd. to Fujian Golden Banyan Foodstuffs Industrial Co., Ltd., which became effective in February 2008.
