AD: Vietnam Certain Frozen Fish Fillets

The International Trade Administration has amended the final resultsof its antidumping duty administrative review of certain frozen fish fillets for the period of August 1, 2005 through July 31, 2006.

The ITA is amending the final results to correct ministerial errors made in the calculation of the AD duty rates for East Sea Seafoods Joint Venture Co., Ltd. (ESS), Can Tho Agricultural and Animal Products Import Export Company (CATACO), and QVD Food Company (QVD). (The rates for ESS and QVD did not change as a result of correcting these errors.)

(a) The ITA continues to find AD duty rates of zero for ESS and QVD, therefore, no cash deposit will be required; however, they are still subject to the order.

1In the final results, the ITA incorrectly stated that CATACO was included in the Vietnam-wide entity and was assigned an AD duty rate of 63.88%. However, in the preliminary results, CATACO received an individual adverse facts available rate of 80.88% and, as no interested parties provided comments on CATACO's rate in the case briefs, the individual adverse facts available rate for CATACO should have been unchanged and listed as 80.88%.

Retroactive Collection of AD Duties Effective March 24, 2008

With respect to CATACO, the ITA will instruct U.S. Customs and Border Protection to collect AD duties for all shipments of the subject merchandise based on these amended final results, retroactively effective for entries with a time of entry on or after March 24, 2008 (the date of publication of the final results).

Assessment Instructions

The ITA states that CBP has already been instructed to liquidate CATACO's entries at the rate in effect at the time of entry.

Because the ITA is currently enjoined from liquidation of any entries of subject merchandise exported by ESS and QVD, it will not issue liquidation instructions to CBP until the conclusion of the litigation.
