ITC Finds Negative AD Critical Circumstances
The International Trade Commission has determined that AD critical circumstances do not exist with respect to those imports of the subject merchandise by the China-wide entity that were subject to the affirmative critical circumstances determination by the ITA.
(The ITA previously found that critical circumstances existed for the China-wide entity; but not for the mandatory or separate rate respondents.)
Therefore, the ITA will instruct U.S. Customs and Border Protection to lift suspension, release any bond or other security, and refund any cash deposit made to secure the payment of AD duties with respect to entries of subject merchandise by the China-wide entity with a time of entry on or after November 1, 2007, but before January 30, 2008 (the 90 days prior to the date of publication of the preliminary determination).
AD Suspension of Liquidation Instructions
The ITA will instruct CBP to continue to suspend liquidation for entries of subject merchandise (including the China-wide entity) with a time of entry on or after January 30, 2008 (the date of publication of the preliminary determination).
AD Cash Deposit Instructions
CBP will require, at the same time as importers would normally deposit estimated duties on subject merchandise, a cash deposit equal to the following estimated AD margins for entries on or after August 4, 20081 (AD rates are unchanged from the final determination):
| Manufacturer | Final AD Rate |
