AD: China Circular Welded Carbon Quality Steel Pipe

ITC Finds Negative AD Critical Circumstances
The International Trade Commission has determined that AD critical circumstances do not exist with respect to those imports of the subject merchandise that were subject to the affirmative critical circumstances determination by the ITA.
Therefore, the ITA will instruct U.S. Customs and Border Protection to lift suspension, release any bond or other security, and refund any cash deposit made to secure the payment of AD duties with respect to entries of subject merchandise with a time of entry on or after October 17, 2007, but before January 15, 2008 (the 90 days prior to the date of publication of the preliminary determination), except for entries exported and produced by Jiangsu Yulong Steel Pipe Co., Ltd.
In specific regard to Yulong, the ITA will instruct CBP to lift suspension, release any bond or other security, and refund any cash deposit made to secure the payment of AD duties with respect to entries with a time of entry on or after January 25, 2008, but before April 24, 2008 (the 90 days prior to the date of publication of the amended preliminary determination).
AD Suspension of Liquidation Instructions
The six month period for which the suspension of liquidation may remain in effect before an AD order is issued (beginning on the date of the publication of the preliminary determination) ended on July 13, 2008 in this investigation. Furthermore, the collection of AD duties are to begin on the date of publication of the ITC's final injury determination.
Therefore, the ITA will instruct CBP to terminate the suspension of liquidation and to liquidate, without regard to AD duties, unliquidated entries of CWP from China with a time of entry on or after July 13, 2008, and before July 21, 2008 (the date of publication of the ITC's final injury determination).
Suspension of liquidation will continue on or after July 21, 2008.
AD Cash Deposit Instructions
The ITA will direct CBP to assess the following AD duties on all unliquidated entries of CWP from China (except for entries of merchandise exported and produced by Yulong) with a time of entry on or after January 15, 2008, and on entries by Yulong with a time of entry on or after April 24, 2008 (AD rates are unchanged from the final determination):
