AD: Korea Light-Walled Rectangular Pipe and Tube
The International Trade Administration has made a final affirmative antidumping duty determination that light-walled rectangular pipe and tube (LWR) from Korea is being, or is likely to be, sold in the U.S. at less than fair value.

Continuation of Suspension of Liquidation (Except Nexteel)
The ITA is expected to instruct U.S. Customs and Border Protection to continue to suspend liquidation of entries of LWR from Korea with a time of entry on or after January 31, 2008, for all producers/exporters other than Nexteel Co., Ltd.
(Because the AD duty rate for Nexteel continues to be de minimis, the ITA is expected to instruct CBP not to suspend liquidation of merchandise produced and exported by Nexteel Co., Ltd., or produced by Nexteel and exported by either of the two companies named in its questionnaire responses1.)
AD Cash Deposit/Bond Requirements
The ITA is also expected to instruct CBP to continue to require an AD cash deposit or the posting of a bond (except Nexteel) at the AD rates specified below for entries of subject merchandise with a time of entry on or after January 31, 2008:

(a) The ITA found a final de minimis AD duty rate of 1.30% for Nexteel. Such a rate is expected to result in the continued exclusion from the AD suspension of liquidation/cash deposit/bond requirements of Nexteel as producer and exporter, and of Nexteel as producer with either of the two exporters named in its questionnaire responses.1
AD Duty Order to be Issued if ITC finds Injury/Threat of Injury
The International Trade Commission will, within 45 days, determine whether these imports are materially injuring, or threatening material injury to, the U.S. industry. If the ITC determines that material injury, or threat of material injury, does not exist, the proceeding will be terminated and all securities posted will be refunded or canceled. If the ITC determines that such injury does exist, the ITA will issue an AD duty order.
