ITA is Postponing Preliminary Determination Due to Complexity, Etc.

The ITA may postpone the preliminary determination until no later than 130 days1 after the date on which the administering authority initiated the investigation, if it concludes that the parties concerned in the investigation are cooperating and determines that the investigation is extraordinarily complicated.

Due to the number and complexity of the alleged countervailable subsidy practices being investigated, the ITA states that it is not practicable to complete the preliminary determination of this investigation within the original time limit (i.e., by June 27, 2008).

Accordingly, the ITA is postponing the due date for this preliminary determination to no later than September 2, 2008.

1The ITA states that as the 130th day falls on a Sunday, the deadline for completion of the preliminary determination is now September 2, 2008, the next business day after the Labor Day holiday.

(See ITT's Online Archives or 04/30/08 news, 08043040, for BP summary of the ITA's initiation of this CV duty investigation as well as the initiation of the antidumping duty investigations of subject merchandise from China and Korea.)
