AD: Brazil, UAE, Thailand PET Film, Sheet, and Strip

The International Trade Administration has made preliminary affirmative antidumping duty determinations that polyethylene terephthalate film, sheet and strip (PET film) from Brazil and the United Arab Emirates is being, or is likely to be, sold in the U.S. at less than fair value.

The ITA has also made a preliminary negative determination for PET film from Thailand (see end of notice for details).

Suspension of liquidation. The ITA will instruct U.S. Customs and Border Protection to suspend liquidation of all entries of PET film from Brazil and the UAE with a time of entry on or after May 5, 2008.

AD cash deposit or bond. The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates listed below, for entries of subject merchandise from Brazil or the UAE with a time of entry on or after May 5, 2008, as follows:

(The ITA notes that in these investigations, if the exporter is not a firm identified in the investigation but the producer is, the rate will be the rate established for the producer of the subject merchandise.)

Deadlines for Brazil and UAE Final Determinations

The ITA states that it is postponing its final determination in the UAE investigation to no later than 135 days after May 5, 2008, and will extend the provisional measures to not more than six months.

The ITA will make its final determination in the Brazil investigation not later than 75 days after April 25, 2008.

Preliminary Negative AD Duty Determination for Thailand

The ITA has also made a negative preliminary determination that PET film from Thailand is not being, nor likely to be, sold in the U.S. at less than fair value, as the preliminary AD margins for Polyplex (Thailand) Public Company Ltd. and All Others were zero. As a result, the ITA will not direct CBP to suspend liquidation nor require any cash deposit or posting of a bond for entries of PET film from Thailand.
