AD: India and China HEDP

The International Trade Administration has initiated antidumping duty investigations to determine whether imports of 1-hydroxyethylidene-1, 1-diphosphonic acid (HEDP) from India and China are being, or are likely to be, sold in the U.S. at less than fair value.

China Q&V Questionnaires Due April 29, Separate Rate Applications Due June 9

In the China investigation, the ITA will request quantity and value information from all known exporters and producers identified in the petition. The quantity and value data received from these non-market economy (NME) exporters/producers will be used as the basis to select the mandatory respondents. The ITA requests that Q&V questionnaires be submitted no later than April 29, 2008. The ITA requires exporters and producers seeking separate rate status in the investigation for China to submit a separate rate application by June 9, 2008. The application is available at http://ia.ita.doc.gov/download/nme-sep-rates/prc-hedp/prc-hedp-ad-init-sr-app-041008.pdf.

Comments on CBP Data, Respondent Selection for India Due April 24th

The ITA states that for the India investigation, it intends to select respondents based on U.S. Customs and Border Protection data for U.S. imports during the period of investigation. The ITA invites comments regarding the CBP data and the selection of respondents within ten days of April 14, 2008.

Comments on Physical Characteristics Due April 28th

The ITA is also requesting comments by April 28, 2008 from interested parties regarding the appropriate physical characteristics of HEDP to be reported in response to the AD questionnaire. This information will be used to identify the key physical characteristics of the subject merchandise in order for respondents to more accurately report the relevant factors and costs of production, as well as to develop appropriate product comparison criteria. (Rebuttal comments must be received by May 5, 2008.)

Scope of the Investigation

The merchandise covered by each of these investigations includes all grades of aqueous, acidic (non-neutralized) concentrations of 1-hydroxyethylidene-1, 1-diphosphonic acid, also referred to as hydroxethlylidenendiphosphonic acid, hydroxyethanediphosphonic acid, acetodiphosphonic acid, and etidronic acid. The CAS (Chemical Abstract Service) registry number for HEDP is 2809-21-4.

HTS Classification. The subject imports are currently classified in HTS subheading 2931.00.9043. They may also enter under HTS subheading 2811.19.6090.

The ITA notes that HTS subheadings are provided for convenience and customs purposes only; the written description of the scope of these investigations is dispositive.

(According to the ITA, HEDP is used in water treatment, detergents and cleaners, peroxide bleach stabilization, and personal care products.)
