AD: China, Australia Electrolytic Manganese Dioxide

The International Trade Administration has made preliminary affirmative antidumping duty determinations that electrolytic manganese dioxide (EMD) from Australia and China is being, or is likely to be, sold in the U.S. at less than fair value.

Combination rate for China. In the China investigation, the ITA has calculated combination rates for respondents that are eligible for a separate rate. (See ITT's Online Archives or 04/11/05 news, 05041110, for BP summary of an April 2005 policy bulletin outlining this change in practice with regard to combination rates for AD investigations involving non-market economies (NMEs).)

Suspension of liquidation for China and Australia, critical circumstances for Delta. The ITA has preliminarily determined that critical circumstances exist for imports from Australia of EMD from Delta Australia Pty Ltd, and therefore it will instruct U.S. Customs and Border Protection to suspend liquidation of all entries of EMD from Delta with a time of entry on or after 90 days prior to March 26, 2008.

For the companies in the all-others category for Australia, and for all entries of EMD from China, the ITA will direct CBP to suspend liquidation of all entries with time of entry on or after March 26, 2008.

AD cash deposit or bond for China and Australia. The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates listed below, for entries of subject merchandise from China or Australia (see below) with a time of entry on or after March 26, 2008, as follows:

(The ITA notes that in the Australia investigation, if the exporter is not a firm identified in this investigation but the producer is, the rate will be the rate established for the producer of the subject merchandise.)

Deadlines for China and Australia Final Determinations

The ITA states that it has extended the deadline for issuance of the final determination in the China investigation until the 135th day after March 26, 2008, and has extended provisional measures to not longer than six months.

The ITA will make its final determination in the Australia investigation within 75 days after March 19, 2008.
