CV: Italy Certain Pasta

The International Trade Administration has issued its final results of the countervailing duty administrative review of certain pasta from Italy for the period of January 1, 2005 through December 31, 2005.

(a) The CV duty rate for Atar is zero; therefore, the ITA will instruct U.S. Customs and Border Protection to continue to suspend liquidation of entries, but to collect no cash deposits of estimated CV duties for Atar; and

(b) For all non-reviewed firms (except Barilla G. e R. F.lli S.p.A. and Gruppo Agricoltura Sana S.r.l., which are excluded from the order, and Pasta Lensi S.r.l. which was revoked from the order), the ITA will instruct CBP to collect cash deposits of estimated CV duties at the most recent company-specific or all-others rate applicable to the company. These rates shall apply to all non-reviewed companies until a review of a company assigned these rates is requested.

Assessment Instructions for the Review Period (01/01/05 - 12/31/05)

The ITA will issue appropriate assessment instructions to CBP 15 days after February 7, 2008.

Because the CV duty rate for Atar is zero, the ITA will instruct CBP to liquidate entries for Atar during the review period, without regard to CV duties. For Pallante and De Matteis, the ITA will instruct CBP to assess CV duties at the net subsidy rates above.

For all other companies that were not reviewed (except Barilla G. e R. F.lli S.p.A. and Gruppo Agricoltura Sana S.r.l., which are excluded from the order, and Pasta Lensi S.r.l. which was revoked from the order), the ITA has directed CBP to assess CV duties on all entries during the review period at the rates in effect at the time of entry. (Agritalia S.r.L. has been reviewed previously and has its own exporter-specific rate of 2.92%.)
