AD: Mexico Fresh Tomatoes

The International Trade Administration has issued a notice of termination of the suspension agreement and resumption of the antidumping investigation on fresh tomatoes from Mexico. The ITA resumes the investigation as an affirmative preliminary determination.

(Mexican tomato growers/exporters accounting for a significant percentage of all fresh tomatoes imported into the U.S. from Mexico provided written notice on November 26, 2007 of their withdrawal from the 2002 agreement (which suspended this investigation). The termination of the 2002 suspension agreement is effective January 18, 2008.)

Jan. 18th suspension of liquidation, cash deposit/bond required. The ITA will instruct U.S. Customs and Border Protection to suspend liquidation of entries of fresh tomatoes from Mexico with a time of entry on or after January 18, 2008.

CBP shall require AD duty cash deposits or bonds for entries of the subject merchandise on or after January 18, 2008 based on the preliminary AD margins, which are as follows:

The ITA intends to issue its final determination in the resumed AD duty investigation by June 2, 2008.
