U.S. Customs and Border Protection has posted a notice announcing that the tariff-rate quota (TRQ) for tuna and skipjack, in airtight containers, not in oil, in containers, weighing with their contents not over 7 kg each, which opened on January 2, 2008, exceeded the preliminary TRQ limit at the opening. All entries presented at the over-quota (high) rate since the opening have been charged and may be released.

1. Preliminary TRQ for Tuna and Skipjack Oversubscribed at Opening

CBP states that it will be informed of the final TRQ limit in March 2008, at which time CBP will issue proration and liquidation instructions to the field/trade. CBP adds that entries should continue to be submitted at the over-quota rate.

CBP states that if a warehouse entry is liquidated prior to CBP's receipt of the final TRQ limit, CBP recommends that the importer file a protest to ensure proper processing of any applicable refund once the final proration is determined. 2. 2008 Dairy Products TRQ Partially Oversubscribed at Opening

CBP has posted a notice announcing that the 2008 TRQ for dairy products, provided for in HTS Chapter 4, Additional U.S. Note (AUSN) 10, which opened on January 2, 2008, partially oversubscribed at the opening. According to CBP, the All Other Countries limit oversubscribed. CBP adds that the Australia and Belgium/Denmark (aggregated) minimum access quantities (MAQs) were not reached at the opening; therefore, the low-duty MAQs are still available on a first-come, first-serve basis until the balance is exhausted.

The pro rata percentage for All Other Countries is 0.712612 or 71.2612%. 3. 2008 Milk and Cream, Condensed or Evaporated TRQ Partially Oversubscribed at Opening

CBP has posted a notice announcing that the 2008 TRQ for milk and cream, condensed or evaporated, provided for in HTS Chapter 4, AUSN 11, which opened on January 2, 2008, partially oversubscribed at the opening. The MAQ for condensed milk in airtight containers from the Netherlands was satisfied. The balance in excess of this MAQ was applied to the "Any country" limit. When a MAQ limit has been reached, the in-quota rate for "Any country" may be used until the balance is exhausted. (See CBP's notice for a list of MAQs that have not been reached and other details.) 4. 2008 Chile FTA Artichokes TRQ Oversubscribed at Opening

CBP has posted a notice announcing that the 2008 TRQ for artichokes from Chile, provided for in HTS Chapter 99, Subchapter XI, U.S. Note 13, entered pursuant to the U.S. Chile Free Trade Agreement (UCFTA), which opened on January 2, 2008, oversubscribed at the opening. According to CBP, the pro rata percentage for subject artichokes is 0.574391 or 57.4391%. CBP has posted a notice announcing that the 2008 TRQ on Italian-type cheeses provided for in HTS Chapter 4, AUSN 21, was scheduled to open on Wednesday, January 2, 2008. The below-listed countries or areas have the following low-duty access amounts:

CBP has posted a notice announcing that the 2008 TRQ on infant formula provided for in HTS Chapter 19, AUSN 2, was scheduled to open on Wednesday, January 2, 2008 with a low-duty quantity of 100,000 kg.

8. 2008 TRQ on Ethyl Alcohol Opened January 2nd

CBP has posted a notice announcing that the 2008 TRQ for qualifying ethyl alcohol from Caribbean countries and Insular Possessions as provided for in HTS Chapter 99, Subchapter I was scheduled to open on Wednesday, January 2, 2008.

The global low-duty quantity is 452,515,000 gallons, while El Salvador has a low-duty quantity of 9,246,051 gallons. CBP notes that if El Salvador fills its allocation, any further imports will be charged to the global restraint limit.

9. Cotton Shirting Fabrics TRQ Opened January 2, 2008

U.S. Customs and Border Protection has posted a notice announcing that the duty-free tariff rate quotas (TRQs) for the importation of certain cotton shirting fabrics suitable for use in making men's and boys' shirts was scheduled to open on Wednesday, January 2, 2008.

The total amount allocated is 3,085,461 square meters equivalent (SME), and companies must have already applied for an allocation. (See ITT's Online Archives or 01/04/08 news, 08010415, for BP summary of the ITA announcing the 2008 TRQ allocations for subject fabric.)
