AD: Korea Certain Polyester Staple Fiber
The International Trade Administration has issued its final results of the antidumping duty administrative review of certain polyester staple fiber from Korea for the period of May 1, 2005 through April 30, 2006.

(a) For previously reviewed or investigated companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;
(b) If the exporter is not a firm covered in this review, a prior review, or the original investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and
(c) If neither the exporter nor the manufacturer is a firm covered in this review, a prior review, or the investigation, the AD duty cash deposit rate will be 7.91%, the "all-others" rate established in the amended final determination and order.
1Note that in its preliminary results, the ITA preliminarily rescinded this review with respect to Dongwoo; however, in these final results, the ITA has determined to apply an adverse facts available (AFA) rate to Dongwoo instead.
Assessment Instructions for the Review Period (05/01/05 - 04/30/06)
The ITA will issue appropriate assessment instructions directly to U.S. Customs and Border Protection 15 days after December 10, 2007.
The ITA calculated importer-specific assessment rates for subject merchandise, which trade sources note may differ significantly from the cash deposit rates listed above.
The ITA adds that for entries of subject merchandise during the review period produced by companies included in these final results for which the reviewed companies did not know their merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the "all-others" rate if there is no rate for the intermediate company(ies) involved in the transaction.
