APHIS Reminder on FY 2008 AQI User Fees, Modest Increase for Commercial Vessels (No Change for Rail/Air/Truck)

The Animal and Plant Health Inspection Service has issued a notice reminding the public of the fiscal year 2008 (October 1, 2007 - September 30, 2008) user fees for agricultural quarantine and inspection (AQI) services provided in connection with certain commercial vessels, commercial trucks, commercial railroad cars, commercial aircraft, and international airline passengers arriving at ports in the customs territory of the U.S.

According to 7 CFR 354.3 and APHIS' reminder, the fee for inspections of commercial vessels has shown a modest increase from FY 2007 levels, while the fees for commercial truck, commercial railroad car, and commercial aircraft inspections remain the same.

(APHIS states that its December 2004 interim rule established user fees for FYs 2005-2010 and beyond for many of the types of conveyances or persons to whom AQI services are provided (i.e., commercial vessels, trucks, loaded commercial railroad cars, commercial aircraft, etc.). APHIS notes that its regulations regarding user fees for certain international services at 7 CFR 354.3 provide specific information regarding the applicability of, and exceptions to, AQI user fees.)

FY 2008 APHIS AQI User Fees Reflect Modest Increase for Commercial Vessels

As specified in 7 CFR 354.3, the APHIS user fees for AQI services for FY 2008 are as follows:

Commercial vessels: $492.00 per arrival (from $490.00). After the 15th entry, no charge.

Commercial trucks: $5.25 per arrival and $105 for an annual AQI permit valid for FY 2008 (no increase from FY 2007).

Loaded commercial railroad cars: $7.75 per arrival and $155 for an annual AQI permit valid for FY 2008 (no increase from FY 2007).

Commercial aircraft: $70.50 (no increase from FY 2007).

FY 2008 Combined CBP/APHIS AQI User Fees For Commercial Vehicles

In addition to the APHIS user fees, which are collected by U.S. Customs and Border Protection, CBP also collects certain user fees for commercial vehicles. According to previous APHIS and CBP notices, the current combined APHIS/CBP user fees for commercial vehicles are as follows:

Commercial Trucks: Total APHIS/CBP per entry fee of $10.75; total AQI/CBP annual fee of $205.

(APHIS: $5.25 per entry; $105 annually. CBP: $5.50 per entry for both the Mexican and Canadian borders (the later had a delayed effective date of June 1, 2007); $100 annually.)

Loaded Commercial Railroad Cars: Total APHIS/CBP per entry fee of $16.00.(APHIS: $7.75 per entry; $155 annually. CBP: $8.25 per entry.
