AD: Brazil, China, Thailand PET Film, Sheet and Strip

The International Trade Administration has initiated antidumping duty investigations to determine whether imports of polyethylene terephthalate film, sheet, and strip (PET film) from Brazil, China, Thailand, and the United Arab Emirates are being, or are likely to be, sold in the U.S. at less than fair value.

Separate Rate Applications for China AD Investigation Due December 17th

The ITA requires exporters and producers seeking separate rate status in the AD investigation for China to submit a separate rate application no later than December 17, 2007. (The ITA notes that in prior non-market economy (NME) investigations, it has been its practice to request quantity and value (Q&V) information from all known exporters identified in the China petition; however, for this investigation, because HTS 3920.62.0090 (see scope below) provides comprehensive coverage of the subject merchandise, the ITA expects to select respondents in this investigation based on U.S. Customs and Border Protection (CBP) data of U.S. imports under HTS 3920.62.0090; therefore, Q&V information is not required for exporters in this investigation.)

Scope of the Investigations

The products covered by these investigations are all gauges of raw, pre-treated, or primed PET film, whether extruded or co-extruded. Excluded are metallized films and other finished films that have had at least one of their surfaces modified by the application of a performance-enhancing resinous or inorganic layer more than 0.00001 inches thick. Also excluded is Roller transport cleaning film which has at least one of its surfaces modified by application of 0.5 micrometers of SBR latex. Tracing and drafting film is also excluded.

PET film is classifiable under HTS 3920.62.0090. The ITA notes that while HTS subheadings are provided for convenience and Customs purposes, the written description of the scope of these investigations is dispositive.
