AD: Italy Stainless Steel Sheet and Strip in Coils
The International Trade Administration has issued a notice implementing its determination under Section 129 of the Uruguay Round Agreements Act for stainless steel sheet and strip in coils from Italy, effective August 31, 2007.

(The ITA initiated this Section 129 proceeding in order to implement a World Trade Organization panel report finding that the ITA's use of "zeroing" in average-to-average comparison AD investigations in 12 European Community investigations is inconsistent with U.S. obligations under the WTO Agreement.)

(a) The AD duty cash deposit rates will remain unchanged for those companies whose cash deposit rates since the original investigation have been superseded by administrative reviews.
Suspension of liquidation. The ITA will instruct U.S. Customs and Border Protection (CBP) to continue to suspend liquidation of all entries of subject merchandise from all exporters or producers, which will remain in effect until further notice.
1After the ITA issued it preliminary Section 129 determination, TKAST alleged clerical errors in the ITA's margin calculation, and after the ITA issued its final results, TKAST submitted an allegation of ministerial errors. The ITA states that it intends to address all ministerial error comments in a subsequent memorandum.
2The Section 129 determination all-others rate (2.11%) will be the new cash deposit rate for all exporters of subject merchandise for whom the ITA has not calculated an individual rate.
