AD: Australia, China Electrolytic Manganese Dioxide

The International Trade Administration has initiated antidumping duty investigations to determine whether imports of electrolytic manganese dioxide (EMD) from Australia and China are being, or are likely to be, sold in the U.S. at less than fair value.

Separate Rate Applications for China Due November 9

The ITA requires exporters and producers seeking separate rate status in the AD investigation for China to submit a separate rate application no later than November 9, 2007. The AD separate rate application is available at http://ia.ita.doc.gov/ia-highlights-and-news.html.

(The ITA notes that in prior non-market economy investigations, it has been its practice to request quantity and value information from all known exporters identified in the China petition; however, for this investigation, because HTS 2820.10.0000 (see scope below) provides comprehensive coverage of imports of EMD, the ITA expects to select respondents in this investigation based on U.S. Customs and Border Protection (CBP) data of U.S. imports under HTS 2820.10.0000; therefore, Q&V information is not required for exporters in this investigation.)

Scope of the Investigations. The merchandise covered by these AD investigations includes all manganese dioxide (MnO2) that has been manufactured in an electrolysis process, whether in powder, chip, or plate form.

Excluded from the scope are natural manganese dioxide (NMD) and chemical manganese dioxide (CMD).

The merchandise subject to these investigations is classified in HTS 2820.10.0000. While the HTS subheading is provided for convenience and customs purposes, the written description of the scope of these investigations is dispositive.
