AD: China Certain Preserved Mushrooms

The International Trade Administration has issued its final results of the antidumping duty administrative review of certain preserved mushrooms from China for the period of February 1, 2005 through January 31, 2006.

(a) For any previously reviewed or investigated China or non-China exporter, not covered in this review, with a separate rate, the AD duty cash deposit rate will be the company-specific rate established in the most recent segment of this proceeding;

(b) For all other China exporters, the AD duty cash deposit rate will be the China-wide entity rate established in the final results of this review; and

(c) The AD duty cash deposit rate for any non-China exporter of subject merchandise from China will be the rate applicable to the China exporter that supplied that non-China exporter.

1The China-wide entity includes Gerber Food (Yunnan) Co., Ltd. (Gerber), Green Fresh Foods (Zhangzhou) Co., Ltd. (Green Fresh), Guangxi Hengxian Pro-Light Foods, Inc. (Guangxi Hengxian), Guangxi Yulin Oriental Food Co., Ltd. (Guangxi Yulin), and Fujian Zishan Group Co., Ltd. (Fujian Zishan), as these companies were determined not to qualify for a separate rate.

Assessment Instructions for the Review Period (02/01/05 - 01/31/06)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection 15 days after August 9, 2007.

The ITA will instruct CBP to assess AD duties on all appropriate entries covered by this review. For entries made by the COFCO entity, the ITA calculated an importer-specific-per-unit duty assessment rate. For Guangxi Eastwing and Primera Harvest, the ITA will instruct CBP to assess AD duties on entries equal to the margin these companies received in the final results, regardless of the importer or customer.
