AD liability, suspension of liquidation (with gap period for April 9-18, 2007).The ITA states that it will instruct U.S. Customs and Border Protection to terminate the suspension of liquidation and to liquidate, without regard to AD duties, unliquidated entries of certain activated carbon from China with a time of entry from April 9, 2007 through April 18, 2007. Suspension of liquidation will resume on April 19, 2007 (the date of publication of the ITC's final injury determination in the Federal Register).

(The ITA is taking this action pursuant to 19 USC 1673b(d), which indicates that suspension of liquidation based on a preliminary determination may only remain in effect for four months.)

AD cash deposit instructions. Effective on April 19, 2007, CBP will require, at the same time as importers would normally deposit estimated duties on the subject merchandise, an AD cash deposit at the rates listed below:

1The ITA has previously stated that Jacobi Carbons AB (Jacobi AB), Tianjin Jacobi International Trading Co., Ltd. (Jacobi Tianjin), and Jacobi Carbons, Inc. (Jacobi US) (collectively, Jacobi) are affiliated, and that Jacobi AB is the appropriate mandatory respondent in this case.

2The ITA has previously noted that the China wide entity includes Datong Huibao Activated Carbon Co., Ltd. (Huibao) and its affiliated company Beijing Hibridge Trading Co., Ltd. (Hibridge). However, ITA sources note that if Huibao is the supplier to Jacobi, the Jacobi rate applies (see table above).

(See ITA notice for more information, including the scope of the order, etc. See Online Archives or 04/02/07 news, 07040215, for BP summary of the amended final AD duty determination.)
