The Commerce Department has issued a press release announcing its preliminary decision to apply U.S. anti-subsidy (i.e., countervailing (CV)) law to imports from China, the first time CV duties will be imposed on imports from a non-market economy. According to the press release, Commerce preliminarily determined that Chinese producers and exporters of coated free sheet paper received countervailable subsidies ranging from 10.90% to 20.35%. The press release notes that Commerce also made preliminary CV determinations for Indonesia and Korea. 2. DoD Final Rule Waives Buy American Act for Certain Guatemala, Bahrain Materials

The Department of Defense (DoD) has issued a final rule, effective March 27, 2007, which adopts the interim rule without change, amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement the U.S.-Bahrain Free Trade Agreement (FTA) and the U.S.-Dominican Republic-Central America FTA (DR-CAFTA) with respect to Guatemala. DoD states that these FTAs waive the applicability of the Buy American Act for some foreign supplies and construction materials and specify procurement procedures designed to ensure fairness. 3. DoD Final Rule Prohibits It from Acquiring U.S. Munitions List Items from Certain Chinese Companies

DoD has issued a final rule, effective March 27, 2007, which adopts the interim rule without change, amending the DFARS to implement Section 1211 of the National Defense Authorization Act for Fiscal Year 2006. Section 1211 prohibits DoD from acquiring U.S. Munitions List items from Communist Chinese military companies. 4. DoD Issues Interim Rule Amending DFARS to Implement DR-CAFTA for the Dominican Republic, Etc.

DoD has issued an interim rule, effective March 27, 2007, amending the DFARS to implement the DR-CAFTA with respect to the Dominican Republic. The rule also adds Bulgaria and Romania to the list of countries covered by the World Trade Organization (WTO) Government Procurement Agreement. Comments are due on or before May 29, 2007.
