AD: Vietnam Certain Frozen Fish Fillets
The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of certain frozen fish fillets from Vietnam for the period of August 1, 2004 through July 31, 2005.

AD Cash Deposit Instructions for a Time of Entry on or after 03/21/07:

(a) For previously investigated companies not listed above, the AD duty cash deposit rate will continue to be the company-specific rate published for the most recent period;
(b) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the manufacturer is, the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and
(c) The AD duty cash deposit rate for all other manufacturers or exporters will be the Vietnam-wide entity rate of 63.88%.
1ITA sources state that that QVD is affiliated with Dong Thap Food Co., Ltd. (Dong Thap) and Company A, and that QVD, Dong Thap and Company A should be treated as a single entity and receive the same rate. (The ITA has noted that because Company A's identity is business proprietary, it cannot be disclosed.)
2The Vietnam-wide entity includes the following companies that the ITA has found are not entitled to a separate rate: Can Tho Animal Fishery Products Processing Export Enterprise (Cafatex), Mekong Fish Company (Mekonimex), Nam Viet Company, Ltd. (Navico), Phan Quan Trading Co., Ltd. (Phan Quan), An Giang Agriculture Technology Service Company (ANTESCO), Anhaco, Binh Dinh Import Export Company (Binh Dinh), and Vinh Long Import-Export Company (Vinh Long), and An Giang Agriculture and Foods Import-Export Company (Afiex).
Assessment Instructions for the Review Period (08/01/04 - 07/31/05)
The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of March 21, 2007.
Additionally, the ITA states that it has calculated importer-specific duty assessment rates for subject merchandise, which trade sources note may differ significantly from the cash deposit rates listed above.
